We handle a wide range of banking-related litigation, including the defense of financial institutions and their officers and directors against many types of claims brought by borrowers, depositors and regulatory agencies. We have defended banks in cases involving complex RICO claims, the developing theory of “aiding and abetting” fraud, and other types of liability in the banking context. Our litigation experience extends to cases involving loans and security interests, lender-liability claims, regulatory penalties, adverse administrative action, bank-versus-bank warranty claims, and receiverships. Our work in the bank-operations context includes the litigation of claims involving forged or altered checks, misappropriation of funds, and other unauthorized account activity.
We also represent banks and other financial institutions with respect to many types of regulatory and transactional matters, such as providing advice to institutions under regulatory supervision, handling mergers and acquisitions of banks and bank holding companies, loan documentation and loan workouts, and obtaining benefits under financial institution bonds and liability policies. Our banking lawyers provide advice to the Independent Bankers of Colorado, a trade association of over 100 banks, and they help many banks and banking organizations with employee training and education on a variety of topics.

Our commercial litigation practice is the core from which several of our attorneys have developed special expertise. Our team of attorneys and paralegals has the experience to successfully handle even the most complex business cases, from inception of the litigation through trial and appeal. Our trial attorneys regularly handle multi-million dollar cases before federal and state courts across the United States, including class actions and cases presented to commercial arbitration panels, regulatory authorities and administrative bodies. Our litigation matters often involve numerous parties and complex claims or defenses, but our client-oriented focus remains the same regardless of the nature or size of the case. We believe it is important for our clients to evaluate litigation from a business perspective, to regularly assess litigation decisions and risks, knowing that their lawyers are skillfully prepared to handle the legal issues and intricacies associated with business litigation. We also focus on litigation planning, at the outset of cases, to achieve efficient results. Our attorneys also are experienced with alternative dispute resolution, including mediation and other potentially cost-effective alternatives to typical litigation. Creditor's Rights/Insolvency
Our creditor’s rights and insolvency lawyers have extensive experience representing businesses in financial distress, and they are recognized among the best in their field.
